In the Nigerian Legal System, the constitutional rights of an accused person
are enshrined in section 35 and 36 of the Constitution of the Federal
Republic as amended (CFRN). When a suspect is described as having
rights, he is acknowledged to be entitled to some rights claimable under the
law. The Nigerian system grants suspects/accused persons fundamental
rights, that are also in the sense of natural rights or inalienable rights granted
to every individual. Among which are the rights of an accused to be
represented by a legal practitioner, the right to be presumed innocent and
regarded as such until otherwise proven guilty and many others. All these
rights are entrenched in the constitution to ensure strict adherence and protect
individuals from being unjustly dealt with. This study is aimed at analyzing
those rights as stated in the Constitution of the Federal Republic of Nigeria
